February 23, 2010Location: Holiday Inn Express 8:30 - 9 PM (after Parrott complex meeting)Facilitator: Suzzann Nordwick Parrot Complex - A special public presentation focusing on the most recent data from the Parrott complex was presented prior to the monthly meeting. Presenters for the meeting were Pat Cunneen from the National Resources Damage Program (NRDP) and Nick Tucci from the Montana Bureau of Mines and Geology (MBMG). Attendees: Jocelyn Dodge, Jim Shive, Dave Palmer, Helen Joyce, Julie Crowley, Janice Hogan, Elizabeth Erickson, David Williams, Bill Macgregor, and Kriss Douglass. Guests - Sara Sparks (EPA), Pat Cunneen (NRD), Tom Malloy (B-SB), Jim Jarvis (B-SB), Wendy Thomi (EPA), and Cindy MacIlveen. EPA 5-Year Review - The 5-year review will have a draft report done by June 2010 with the final report done in September 2010. CTEC will be having two public outreach meetings. The first meeting will be February 24th, at the Butte Public Library, from 6-8pm. The second meeting will be March 3rd, at the Butte Chamber of Commerce, from 7-9pm. Butte Priority Soils Operable Unit (BPSOU) - May 1st is the target date for the Consent Decree to be signed. Granite Mountain Memorial Interpretive Area (GMMIA) - Seed will be planted at the Mt. Con mine yard this spring. There will be a combined BRA and Park board field trip to the area after ARCO is done. Montana Street Pedestrian Bridge - Jocelyn Dodge gave a review of the past history and current status of the proposed bridge project. There will be a public meeting concerning all CTEP projects February 24, 2010, on the third floor of the B-SB courthouse at 7:30 pm. The BRA gave approval for continued support of a Montana Street crossing. Nick Jaynes will representative the BRA at the meeting. Money for the bridge is being provided through the state's Community Transportation Enhancement Program (CTEP), Butte-Silver Bow and Atlantic Richfield Company. The CTEP money source is meant strictly for pedestrian projects. Sara Sparks remembered a legal obligation concerning this subject and the Lower Area One (LAO) agreement. It was recommended to look at this legal agreement to see what was required. BRA Membership - New members for 2010 are being recruited. Applications are online at ButteRestorationAlliance.org. Applications need to be returned to Tom Malloy at the BSB Planning Department. The deadline for turning in new applications has been extended to March 19, 2010. Every two years 2 sub-committee members and 1 co-chair rotate. This year the environmental and neighborhood sub-committees are up for new chairs. This will be further discussed at the March meeting. Tom Malloy - Reclamation Manager, BSB Planning Department. The Butte Priority Soils Operable Unit (BPSOU) Consent Decree (CD) - The CD has been extended until May 2010. The next meeting will be in March 2010. Public comment will follow. Operating and Maintenance plans have to written for mine waste, the lagoons and storm water. Granite Mountain Memorial Phase II (GMM) - The water has been installed. The lime and 18" topsoil are ready for spreading. Grass will be seeded this spring. The BRA would like to talk about any other ideas or suggestions concerning the reclamation while there is still time to have input. They would also like to get in place a plan for community/neighborhood involvement to help protect the improvements made from vandalism. Tom will provide a tour for anyone interested. The Syndicate Pit - The reclamation is almost complete. Clark Street has been reopened on the west side. The grass will be seeded this spring. Arco Redevelopment Trust (RT) - The board for the trust will be formed after the BPSOU consent decree is signed. Montana Street Pedestrian Bridge - A flyer was passed around showing the proposed location and design options for the walking trail bridge. The bridge proposal has been in the planning stage since 2001. Money for the bridge is being provided through the state's Community Transportation Enhancement Program (CTEP), Butte-Silver Bow and Atlantic Richfield Company. The will be a public meeting February 24, 2010, on the third floor of the B-SB courthouse at 7:30 pm. 5-Year Review Public Outreach Meeting - CTEC will be having two public outreach meetings. The Environmental Protection Agency (EPA) and the Mt Department of Environmental Quality (DEQ) are currently interviewing local people concerning their views on the effectiveness of the Superfund remedy in the Butte area. The 5 -year review will have a draft report done by March 2010 with the final report done in September 2010. Butte Natural Resource Damage Council (BNRC) - Pat Cunneen - Six members have been appointed locally by Chief Executive Paul Babb. The members are Elizabeth Erickson, Mark Gollinger, Ruth Lee, John McKee, Chad Okrusch, and Emmett Riordan. Governor Schweitzer will appoint three additional members to the council soon. The BNRC will be asking for input from the BRA as well as other groups once the council is up and running. BRA Membership - A revised list of BRA members will be made available after all current members contact Nick or Suzzann to let them know if they wish to continue as a BRA member. Vandalism - Dave Palmer - The group, Butte Rallying Against Vandalism (BRAVE) meets monthly. Some areas addressed are curfews, DUIs and vandalism. A misdemeanor probation officer was hired January 25, 2010. They are planning future community forums. Anyone is welcome to attend BRAVE meetings. Historic Preservation Ordinance - Jim Jarvis - the Historic Preservation ordinance guidelines are being finalized. Parrot Tailings - A special meeting focusing on the most recent data from the Parrott Tailings will be combined with the next Butte Restoration Alliance Meeting (BRA), February 23rd, Holiday Inn Express. This combined CTEC/BRA environmental sub committee Parrott meeting will be from 6-7:30 PM. The rest of the BRA regular meeting will continue until 9:00pm. Anyone interested in the Parrott Tailings is welcome to attend. Sanborn Maps - Montana has a free hookup to look at Sanborn maps. The password is bitterroot and welcome for those interested in accessing the site. Montana Pole Treatment Plant Superfund Site - Reuse Plan. Future land use of the site needs to be coordinated with Lisa Dewitt (DEQ), Butte Silver Bow, and CTEC. Next Meeting: February 23rd, Holiday Inn Express, from 6-9 PM. Clark Fork Watershed Education Program (CFWEP) - The Science Café discussion for December will be "Exploring the Underground-The Butte Storm Water System" with Josh Vincent. The discussion will be December 3, 2009, from 7-9pm, at the Blue Luna. Kids Fishing Pond - A design workshop is scheduled for December 1, 2009 at the Hillcrest School Gym from 7:00 to 9:00 pm. Public comments are welcome. Water Park at Clark Park - Butte-Silver Bow County is putting in the infrastructure. Some greenery has been removed to make room for a parking lot. Environmental Protection Agency Five-Year Review - CTEC is planning public outreach meetings early next year. Pat Cunneen - National Resource Damage Council - 61 applications were received for the Butte Natural Resource Council (BNRC). 6 candidates will be appointed locally by the end of the month. Governor Schweitzer will appoint three additional members by the end of the year. Restoration Alliance Membership Drive - Current members are asked to let Nick or Suzzann know if there are planning to continue their membership. New members will be recruited in January. Board members will be elected at the January meeting, as well as new chairpersons for the Environmental and Neighborhood sub-committees. Montana Pole Plant Site - Suzzann will ask Lisa Dewitt, Program Manager from DEQ to come to a Restoration Alliance meeting to update everyone on the MT Pole plant. Specifically its timeline, future use planning, and concerns about the well water levels. Vandalism - another forum on vandalism is being planned. The Restoration Alliance offered to help plan the forum and get community involvement. One possibility would be to have smaller neighborhood meetings. Historic Preservation Grant - Jim Jarvis and Jim Shive turned in a request for a grant for the Original Mine yard for $43,000. The grant is through House Bill 645 Historic Preservation Competitive Grant Program. The next meeting will be January 26, 2010, from 7-9pm, at The Holiday Inn Express.

Tom Malloy - Reclamation Manager, BSB Planning Department. Janice Hogan - CTEC TAG Coordinator- The 5-year review of the cleanup at the Silver Bow Creek/Butte Area Superfund site has begun. Site Inspections were conducted the week of October 6, 2009 for the Streamside Tailing operable unit (OU), Butte Mine Flooding OU, Butte Priority Soils OU, Rocker Timber Framing and Treatment Plant and the Warm Springs Ponds OU. The 5-year review is a regular checkup on the Superfund site to ensure the clean-up decisions continue to protect human health and the environment. The review will be completed by September 2010. At the November CTEC meeting, Roger Hoogerheide, the EPA project lead for this review and the CTEC technical advisors will discuss the review to this point. The meeting is November 17th at the Metals Bank Grill from 7-9. Any one interested in learning more details concerning the review is welcome to attend. Pat Cunneen - National Resource Damage Council - Applications are being accepted for the Butte Natural Resource Council (BNRC). Any BRA members interested in being on the council are encouraged to apply. BNRC council applications are being accepted until October 30, 2009. After the meeting the application deadline was moved to November 13, 2009. Jim Jarvis - BSB Historic Preservation Officer. Jim talked about the House Bill 645 Historic Preservation Competitive Grant Program. Jim gave the letter written by the BRA to Paul Babb concerning BRA's support and encouragement for BSB to apply for a grant for Original mine yard. Butte-Silver Bow owns this property. Jim Shive and Jim Jarvis will work on the grant application. The deadline for submitting applications is November 16, 2009. BRA will also contact other groups in the community applying for grant money to offer support in the form of a letter. Revonda Stordahl - Revonda has contacted Dave Palmer to get a letter from Butte-Silver Bow to see what is expected from the BRA concerning housing demolition and Historic preservation input. She will also contact Nancy Barry to see if she has the letter. The BRA Historic and neighborhood sub-committees will work together on this project. Kriss Douglass - Parrott Tailings. The Bureau of Mines and Geology has received more funding to delineate the boundaries and depth of the tailings. The source of contamination downstream needs identified before a decision can be made whether to remove the tailings. The cost of removal will depend on the boundaries and depth of the tailings. The data is not available from the additional drill sets around the Parrott. "What do we know about the Down gradient plum?" The Bureau conducted a water test this week. Arco performed a tracer study. NRDP is planning an aquifer test. What other sources could influence groundwater? Tom Malloy gave a summary of the construction of a new bus storage facility using $600,000 stimulus money the county has received. It will be built with the other county shops behind the Civic Center. John Ray has concerns this is the same area where the Parrott tailings are located. Jocelyn Dodge - Nick and Jocelyn have been on the council working on the pedestrian bridge to be located on Montana Street. There will be public meetings for ideas. Suzzann Nordwick - Redevelopment of the Mt Pole site. The BRA will work with CTEC. A committee will be formed to conduct public meetings for potential uses of this site when the cleanup is completed. Jenny Wilson - Campus Corps. Jenny is located in the Petroleum Building on the Montana Tech Campus. The Campus Corps engages college students in meeting community-identified needs through volunteer service. They volunteer for community agencies, non-profit organizations, schools, and healthcare facilities. Campus Corp could be utilized for BRA projects. Jenny is a Campus Corps team leader. The public vandalism forum was held in August 13th at the Butte Civic Center. Vandalism and safety issues at the mine yards are still a problem. It is becoming more common as the mine yards become accessible. Pat Holland, the new facililties manager, will be invited to next month's meeting to discuss options. A possible ordinance/law targeting trespassing on BSB property and a design limiting access to the head frames was discussed. It is difficult to distinguish who is responsible for specific areas. Mark Reavis will check into this. Sustainability of the mine yards after Superfund for O&M might possibly come from funding for the through a Historical Structures Grant or an NRDP grant. Julie will ask Jim Jarvis specifics on the Historic Structures Grant. The county requested Alliance discussion towards addressing Dave Palmer's request for the BRA to propose alternatives to dealing with future HPC demolition cases. Suzzann volunteered to lead this subcommittee if it is formed. Nick will send Dave an e-mail to see what the council wants from this sub committee. The revised community needs assessment with be addressed next month. Nick will e-mail the current priorities list to the members. Brian Holland will facilitate the next Meeting. THE FOLLOWING IS JUST A QUICK SUMMARY OF THE MEETING. Janice summarized the July meeting. The alliance spent most if the time on the BRA power point presentation to be presented to the council of commissioners. Sara Sparks - EPA- superfund update on current activities. See attached handout. Tom Malloy - Reclamation Manager, BSB planning department. Tom updated on the NRD and ARCO Redevelopment Trust advisory board formations. There was nothing new to report. Paul Babb will be in charge of forming both councils. Suzzann Nordwick - Suzzann gave Pat Cunneen a brief presentation of the history of the BRA before the meeting. See attached handout. Pat Cunneen - National Resource Damage Program (Butte office) - Pat introduced himself as the new NRDP project officer in Butte. He discussed some activities with the Parrott Tailings and the Big Hole diversion dam since he started his new position. The NRDP council will be formed in September. An announcement will be in the Mt Standard by the end of August soliciting board members. The is a meeting in Helena tomorrow regarding NRDP grants to be awarded. Dave Palmer followed up on the presentation to the BSB council of commissioners. He recommended the BRA keep in touch with Paul Babb. Nick Jaynes - updated the BRA on activities related to the community forum to address persistent neighborhood problems such as vandalism, drug houses, blight, vagrancy as well as other issues. The forum is to be held August 13th. The next planning meeting for the forum is August 3rd. Everyone is welcome to attend the forum as well as any planning meetings. Dick Gibson - Gave an informational presentation on the history of the BSB's Historic Preservation Ordinance and the Historic Preservation Commission (HPC) and their relationship to the Butte Historic Landmark District. The county requested the alliance to discuss the potential rolls they may provide to assist the county and property owners in addressing community concerns of "historic preservation" and "neighborhood enhancement". The revised community needs assessment with be addressed through e-mail. Bill Macgregor will facilitate the August Meeting. The next BRA meeting will be August 24, 2009 at 7pm at the Holiday Inn Express.

The summary of the May 26, 2009 meeting with Virginia Tribe were discussed. Dick Gibson, from The Butte Restoration Alliance, will be attending and presenting at the Council of Commissioners meeting June 24, 2009. Dick will be showing The Butte Restoration Power Point presentation and letting the commissioners know of the restoration Alliance's interest on having seats on both the council being formed for the Restoration Trust (RT) fund and the Butte NRD council. All Restoration Alliance members are asked to attend to show their support. The alliance spent most of the meeting updating the power point presentation that will be shown at the council meeting. The revised community needs assessment will be discussed at the next meeting. There will be a roundtable brainstorming session leading to prioritization of a new community needs list. Each alliance member is asked to seek community input to get ideas of the priorities and needs in the community. Dave Palmer is organizing a community forum to address persistent neighborhood problems such as vandalism, drug houses, blight, vagrancy as well as other issues. The forum is to be held August 13th. The next planning meeting in June 20th. Everyone is welcome to attend the forum as well as any planning meetings. Janice Hogan will facilitate the July Meeting. She will contact Pat Cunneen from the National Resource Damage Program - Butte staff to attend and present at our next meeting. Ginny Tribe was not able to come to the meeting because of the poor road conditions. Suzzann passed out a draft agenda for people to look over and think about before the next meeting when Ginny will come to facilitate. Suzzann will send the agenda electronically. Follow-up plans on our letter to Mr. Babb and the Council: Nick will send an e-mail to Paul Babb following up on the BRA letter given to him earlier this month. He will make sure that he received the letter. He will also ask if he has any questions, needs more information, can provide options and ask how we should proceed. The letter was also copied to the Council of Commissioners. When the council receives the letter it will be put on their agenda. Dave recommended we continue with the current plan in a timely manner. The BRA needs to prepare a brief power point presentation and an informational packet telling about the organization to be presented to the council. Cindy will let us know when the letter goes to council. The executive committee will get this information together. Update on the NRD/ARCO board talks The interviews are in progress for the Natural Resource Damage Program (NRDP) Environmental Science Specialist position. The new person will be in charge of forming the NRDP board. BRA's role in prioritizing projects or leverage funding for Economic Stimulus money BRA needs to think about and prioritize projects that could possibly be done with stimulus money. The projects need to be "shovel ready". We discussed projects such as a Youth Facility, a program to reduce vandalism, $ to fix up houses not in the URA. Merger Meeting 6:30 - 7:00pm
Merger MeetingThe Butte Restoration Alliance (BRA)/Citizen's Technical Environmental Committee (CTEC) merger meeting began at 6:30. All members of both organizations had been invited.Attendees: Steve Ackerlund, Elizabeth Erickson, Suzzann Nordwick, Jim Shive, Kriss Douglass, Dave Williams, Cindy McIlveen, Wendy Thomi, Mindy McCarthy, Helen Joyce, Tom Malloy, Nick Jaynes, Dick Gibson, John Ray, Kim Draper, Leland Greb and Janice Hogan Steve Ackerlund, of Steve Ackerlund, Inc., handed out a final memorandum, the pros and cons, and the Strawman merger proposal. It was brought up that a TAG group cannot accept services, supplies or money from a PRP which would include Butte Silver Bow. Currently BRA does work with BSB on some projects. The merger would be very confusing. Keeping the TAG funds used only for superfund expenses would be very confusing. TAG groups can not lobby. Wendy Thomi asked for a show of hands of people who did not want to proceed with merger talks. Steve Ackerlund asked if the group still wanted to continue talks. John Ray commented that we are spending too much time for a merger with unclear benefits and procedural difficulties. Dick Gibson motioned for those against the merger between CTEC and the BRA to raise their hands. The majority voted against the merger. It was seconded by Jim Shive. The merger discussion has ended. It was recommended that the BRA and CTEC make a formal plan to work closely with the BRA in the future. The meeting was adjourned at 7:00

MinutesSuzzann Nordwick welcomed the new Butte Restoration Alliance (BRA) members GeorgeEverett, Mindy McCarthy, and Tom Richardson.The BRA/CTEC merger meeting prior to the regular meeting was discussed. The merger seemed to increase complexity with no clear benefits for either organization. The two organizations voted not to merge. Nick discussed The National Resource Damage Program (NRDP) fund and the Arco Redevelopment Trust (RT) fund advisory councils that are being formed. After last month's BRA meeting, the BRA executive committee met to discuss the BRA's position concerning the formation of these boards and the BRA's role on each board. The BRA has drafted a letter to be sent to Paul Babb. Nick will e-mail the draft letter to BRA members for comments. The finalized letter will be sent to Paul before the next monthly meeting. Cindy McIlveen mentioned the NRDP job for the Environmental Science Specialist has closed. This position will be located in Butte. The position is primarily responsible for: coordinating the development of and overseeing the implementation of a final restoration plan for the Butte Area One injured site, evaluating and overseeing the implementation of other NRDP funded restoration projects in the Butte area, and conducting public outreach and agency coordination. Tom Malloy handed out and talked about section 15.2 from the BSB/ARCO allocation agreement dated December 2006 and Section III.B of the B-SB Position Paper on the makeup of the Redevelopment Trust governing authority. Tom discussed the guidelines in forming the Redevelopment Trust (RT) board. Tom and Cindy are part of the BSB group writing an ordinance for RT to get a board in place. The new board will then create their own by-laws and appoint their own advisory board. Consent Decree negotiations for the Butte Priority soils Operable Unit have been extended through May. There is a vacancy for the chairperson in the Historic Preservation sub-committee since the resignation of Dick Gibson. Julie Crowley has been nominated as a candidate to fill the position. Jocelyn Dodge nominated Julie seconded by Dave Williams. A vote was taken by the group. Julie will fill the chairperson position in the Historic Preservation sub-committee. Janice Hogan updated us on the Rally Round the Creek, April 7, 2009. It will be held at the Butte Chamber Visitor Center from 6-9. The rally is for the community to get informed and involved in water quality issues of the Silver Bow Creek area. Numerous booths from organizations interested in Silver Bow Creek will be set up. The technical advisors for The Citizen's Technical Environmental Committee (CTEC) and The Clark Fork River Technical Assistance Committee (CFRTAC) will provide updates from recent reports concerning Silver Bow Creek. There is a vacancy for the chairperson in the Mt Con sub-committee since the resignation of Jim Shive. Julie Crowley was nominated as a candidate to fill the position. Jim Shive nominated Julie which was seconded. A vote was taken by the group. Julie will fill the chairperson position in the Mt. Con sub-committee. This sub-committee will meet before the next monthly meeting to discuss possibly incorporating this sub-committee back into the general alliance. Jim Shive's historic preservation letter concerning demolition will not be sent to the commissioners. It will be kept in the file as a future resource. Jocelyn Dodge wrote a letter to Ed Banderob about his Butte scenic drive. The letter gives our support but informs him we are not set up to provide assistance. The letter gave him options that may provide him with assistance. Open Discussion: Nick concerning E-mail length. Try to keep communication focused and brief. Jocelyn Dodge mentioned that at the next monthly meeting Ginny Tribe will be coming. Ginny will focus on process issues, decision making and a strategic plan. She will help reaffirm the BRAs vision and goals. Kriss Douglass and Elizabeth Erickson will have a combined Environmental sub-committee/CTEC meeting to discuss the future roles of each group. Nick Jaynes welcomed the new Butte Restoration Alliance (BRA) members GeorgeEverett, Mindy McCarthy, Leland Greb and Tom Richardson. A powerpoint presentation telling about the BRA was shown. Suzanne passed out the guiding principals/ BRA Membership Agreement for everyone to read and sign. Suzann updated on The Citizens' Technical Environmental Committee activities. The Technical Assistance Grant (TAG) applications to the Environmental Protection Agency (EPA) for Silver Bow Creek/Butte Area and The Montana Pole Site are almost complete. There is a public rally planned at the Chamber of Commerce for April 7, 2009 concerning Silver Bow Creek water recontamination issues. Steve Ackerlund's memo about a possible merger of the BRA and CTEC was handed out. Steve is facilitating the discussion between the BRA executive committee and CTEC Board of Directors. The alliance voted it was okay to continue the merger meetings. Cindy McIlveen discussed The National Resource Damage Program (NRDP) fund and the Arco Redevelopment Trust (RT) fund. Two advisory councils are being formed. One to oversee the spending of the 28.1 million NRDP and the other to oversee the spending of the 15 million RT money. It was discussed that The BRA would like one position on each board. The job announcement for the Environmental Science Specialist for the NRDP will be advertised in the next couple of weeks. This position will be located in Butte. The position is primarily responsible for: coordinating the development of and overseeing the implementation of a final restoration plan for the Butte Area One injured site, evaluating and overseeing the implementation of other NRDP funded restoration projects in the Butte area, and conducting public outreach and agency coordination. Paul Babb, BSB department heads and The Council of Commissioners may be invited to the next RA meeting planned for March 24, 2009. Another meeting will be scheduled in 2 weeks to write a letter asking that a BRA member be put on each council. The next BRA meeting will be March 24, 2009 at 7pm at the Holiday Inn Express.

Positions were decided for the next 2-year period. Nick Jaynes will remain as the alliance co-chairman; Helen Joyce will be replaced by Susann Nordwick as the second alliance co-chairman. Dick Gibson will continue as the historic preservation sub-committee chairman. Jocelyn Dodge will continue as the recreation sub-committee chairman. There will no longer be a secretary-treasurer position. Janice Hogan will write minutes for the meetings. Minutes will be forwarded to Nick Jaynes who will forward to Dick Gibson to post on the website. Any comments or changes can be made to Dick Gibson. Cindy McIlveen will continue to set up the meeting room. Nick handed out a self-assessment form for current alliance member to fill out. The form is designed to reflect on the role of members and to communicate any issues that members may have with the group. Our roles, goals, and priorities can be addressed for next year. Cindy Mcllveen will contact current alliance members to see if they want to continue next year. Cindy will publish an article or press release to get the information about the openings to the public. Current members can put the word out. Wendy Thomi will post on the EPA website. Dick will post on the Alliance website. CTEC can post at the office. The executive committee will make recommendations. New members can be notified as soon as possible so they can attend the next meeting in January. The current power point presentation with additions can be shown at the meeting. It was recommended that the council of commissioners be invited to RA meeting in the near future. The National Resource Damage (NRD) funds were discussed including framework plan, a possible local NRD manager, the advisory council, and NRD grants. There is a meeting January 5, 2009 in Deer Lodge concerning the future of the funds. Anyone interested should attend. Legendary Mountain, a film funded by the Ananconda Company in 1974, was shown. Our next meeting will be January 27, 2009 at 7pm at the Holiday Inn Express.
